Welcome to javierpereira.coffee, the online store of Javier Pereira Coffee LLC, a Florida limited liability company located at 2 S Biscayne Boulevard, Suite 3200 #2386, Miami, FL 33131, United States.
These Terms and Conditions are a contract between you and Javier Pereira Coffee LLC. By using this site or placing an order, you agree to them. If you do not agree, please do not use the site.
If you are shopping from Colombia at javierpereira.cafe, you are contracting with Javier Pereira S.A.S. under Colombian law, and different terms apply.
1. Who may use the store
You must be at least 18 years old, or the age of majority where you live, and able to enter into a binding contract. By ordering you confirm that you are, and that the payment method you use is yours or that you are authorized to use it.
2. Products
We sell roasted specialty coffee from Colombia, whole bean or ground, in the sizes shown on each product page. Coffee is a natural agricultural product: colour, aroma, and flavour vary from harvest to harvest, and photographs are illustrative. Roast dates, tasting notes, and origin information are given in good faith and to the best of our knowledge.
Coffee is a food. Nothing on this site is medical advice, and we make no claim that our coffee prevents, treats, or cures any condition. Our coffee is roasted and packed in a facility that handles coffee only; we do not add flavourings, and we do not claim the facility is free of any particular allergen.
Under California's Proposition 65, the state has determined by regulation (Cal. Code Regs. tit. 27, § 25704) that chemicals created by roasting and brewing coffee pose no significant risk of cancer, and no Proposition 65 warning is required for coffee.
3. Prices and availability
Prices are shown in United States dollars and do not include shipping. Shipping, and any sales tax that applies, are calculated and shown at checkout before you pay.
We may change prices at any time, but the price that applies to your order is the one displayed when you place it. Products are offered while stocks last; availability shown on the site is our best estimate and is not a guarantee.
If a product is listed at an obviously incorrect price because of a typographical or system error, we may cancel the order and refund you in full rather than fulfill it. We will tell you before doing so.
4. Orders and acceptance
Your order is an offer to buy. The contract is formed when we send you an order confirmation email. Until then we may decline or limit any order — for example if the item is out of stock, if we cannot verify the payment or the address, or if we suspect fraud or resale in violation of these terms. If we decline your order, we refund any amount charged in full.
5. Payment
Payments are handled by Stripe, Inc. on Stripe's own secure checkout page. We never receive or store your full card number. By paying you also accept Stripe's terms. If your payment is declined or reversed, we may cancel the order.
Discount codes cannot be combined with other promotions unless we say so, have no cash value, and may be withdrawn or expire.
6. Shipping and returns
Shipping, delivery times, and our dispatch commitment are set out in the Shipping Policy. Returns, refunds, and our freshness guarantee are set out in the Returns and Refunds Policy. Both are part of these Terms.
7. Your account and conduct
You agree not to use the site to break the law, to interfere with its operation or security, to scrape or copy it by automated means without our permission, to resell our products commercially without a written agreement, or to submit false information. We may suspend access if you do.
8. Reviews and content you submit
If you submit a review or other content, you confirm it is your own honest opinion and does not infringe anyone's rights, and you grant us a non-exclusive, royalty-free, worldwide licence to display, reproduce, and adapt it in connection with the store and our marketing. We may decline to publish or may remove content that is unlawful, offensive, off-topic, or misleading. We do not pay for reviews and we do not remove a review just because it is negative.
9. Intellectual property
The name Javier Pereira Coffee, our logo, packaging design, photographs, and the text of this site belong to Javier Pereira Coffee LLC or are used with permission. You may not copy or use them commercially without our written consent. You may share links to the site freely.
10. Email
If you subscribe, we will send you marketing emails. Every one has an unsubscribe link, and we honor unsubscribes as described in our Privacy Policy. Transactional emails about orders you placed are not marketing and cannot be unsubscribed from while an order is in progress.
11. Links to other sites
The site may link to sites we do not control, including our Amazon store. We are not responsible for their content, their products, or their privacy practices. Read their terms before using them.
12. Disclaimers
The site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We do not warrant that the site will be uninterrupted, timely, secure, or error-free, or that any defect will be corrected.
Nothing in these Terms limits any warranty or right that cannot be limited under applicable law, including your rights as a consumer under the laws of your state.
13. Limitation of liability
To the fullest extent permitted by law, Javier Pereira Coffee LLC and its members, officers, and employees will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising out of your use of the site or our products.
Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Some states do not allow certain limitations, so parts of this section may not apply to you.
14. Indemnity
You agree to indemnify and hold harmless Javier Pereira Coffee LLC from claims, damages, and reasonable legal fees arising out of your misuse of the site or your breach of these Terms.
15. Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you and we consent to their jurisdiction.
Before filing anything, please write to [email protected]. Most problems are a wrong bag or a late package, and we would rather fix it than argue about it. We commit to responding within five business days.
16. Severability and waiver
If any provision of these Terms is held unenforceable, the rest remain in force. Our failure to enforce a provision is not a waiver of it.
17. Changes to these Terms
We may update these Terms. The version that governs your purchase is the one published when you place your order. The "Last updated" date at the top always reflects the current version, and material changes will be announced on the site.
